Ulysses advised a group of companies operating in the cryptocurrency industry on the possibility of taking a pledge over borrowers’ securities as collateral for the provision of cryptocurrency assets to the same borrowers. The mandate required reconciling Ukrainian securities and pledge law with the commercial and technical features specific to cryptocurrency-asset lending.
Our advice covered the availability and enforceability of a securities pledge as collateral, applicable regulatory considerations, the perfection and enforcement of the collateral, and contractual mechanics linking the pledge to the provision of cryptocurrency assets.
