On 9 February, Oleh Marchenko, Disputes Partner, in a lecture at Legal High School, discussed UAH 6.5 billion cartel fines imposed by the Antimonopoly Committee of Ukraine against Philip Morris, BAT, Imperial Brands, and JTI in 2019.

The Supreme Court invalidated these fines in 2021. Oleh explained how in this cartel case, the Committee violated practically all fundamental standards of due process guaranteed by Ukraine’s treaties and its national law, including the applicable standard of proof, the right to be heard, and defense rights.
